10 SMS & Voice Communication Compliance

Because our Services include SMS and voice-based outreach, the following Australian rules apply in addition to general privacy law:

  • Spam Act 2003 (Cth) - commercial SMS messages sent via our Services must include sender identification and a functioning unsubscribe/opt-out mechanism, and require consent (express or reasonably inferred) from the recipient.
  • Do Not Call Register Act 2006 (Cth) - telemarketing-style voice calls must not be made to numbers on the Do Not Call Register unless an exemption or existing business relationship applies.
  • Consent & opt-out - end-users may opt out of SMS or voice communications at any time, and salons are responsible for honouring opt-outs promptly within their systems.

11 Call Recording Notice

State and territory surveillance/listening device laws in Australia generally require that a party to a call be notified when it is being recorded. Where our voice bots record or transcribe calls, an audible or written notice (e.g. "this call may be recorded and processed by an AI assistant") must be provided at the start of the interaction. Salon clients are responsible for ensuring this notice is enabled and delivered to their customers.

12 Data Breach Notification

We maintain practices consistent with the Notifiable Data Breaches (NDB) scheme under the Privacy Act 1988 (Cth). Where an eligible data breach is likely to result in serious harm, we will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals in accordance with our legal obligations.

Many small businesses with annual turnover under $3 million are exempt from parts of the Privacy Act 1988 (Cth). 14 Shared Responsibility With Salon Clients

Salon Ignite AI processes end-user data (Section 01c) on behalf of our salon clients under a service agreement. Salon clients remain responsible for:

  • Having their own privacy policy or notice available to their customers;
  • Ensuring appropriate consent is obtained for SMS, voice, and chatbot communications;
  • Notifying customers that they may be interacting with an AI-powered system and that calls or messages may be recorded;
  • Responding to their own customers' privacy requests, with our reasonable assistance.
